GOSSHIPS INTELLIGENCE TERMS OF SERVICE

These Terms of Service (”Terms”) are a binding agreement between you and Gosships LLC, a Delaware limited liability company (”Gosships Intelligence,” “we,” “our,” or “us”), governing your access to and use of the Gosships Intelligence publication, website, newsletters, reports, and related content (collectively, the “Publication”). The Publication is distributed through the Substack platform.
By subscribing to, accessing, or using the Publication, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not subscribe to or use the Publication.
1. Eligibility
You must be at least 18 years old and able to form a legally binding contract to subscribe to or use the Publication. By using the Publication, you represent and warrant that you meet these requirements. The Publication is intended for a professional audience and is not directed to children.
2. The Publication and Availability
Gosships Intelligence provides oil shipping and energy market news, analysis, and commentary through free and paid subscription tiers. We may add, change, suspend, or discontinue any part of the Publication, including any content, tier, feature, or report, at any time. The Publication is hosted and delivered by Substack, and your use is also subject to Substack’s own terms and policies. We do not guarantee that the Publication will be uninterrupted, error free, or available at any particular time, and we are not responsible for outages, delays, or failures caused by Substack, payment processors, or other third parties.
3. Informational Purposes Only; No Professional Advice
All content published by Gosships Intelligence is provided for general informational and educational purposes only. Nothing in the Publication constitutes, and it should not be relied upon as, legal, financial, investment, trading, tax, brokerage, insurance, compliance, or other professional advice, nor an offer, solicitation, or recommendation to buy, sell, or transact in any security, commodity, vessel, freight instrument, or other asset.
The Publication may contain forward-looking statements, forecasts, and opinions that involve uncertainty and may prove incorrect. You are solely responsible for your own decisions and should consult qualified professionals before acting on any information provided. No fiduciary, advisory, agency, or professional-client relationship is created between you and Gosships LLC by your use of the Publication, and you act on the content at your own risk.
4. No Warranties
The Publication and all content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties regarding the accuracy, completeness, reliability, timeliness, or availability of the content.
We strive for accuracy in all reporting and analysis, but market conditions, regulatory frameworks, and geopolitical situations change rapidly, and content may become outdated or contain errors. We make no representation that the content is appropriate or available for use in any particular location.
5. Subscriptions, Billing, Auto-Renewal, and Cancellation
Free and paid tiers. Certain content is available free of charge, and certain content, including the Founding Black Gold Membership tier, requires a paid subscription. Paid subscription fees and billing intervals are presented at the point of purchase.
Billing and payment. Payments are processed by Substack and its payment processor, Stripe. By starting a paid subscription, you authorize us and our processors to charge your selected payment method for the applicable fees.
Automatic renewal. Paid subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date. You authorize recurring charges to your payment method until you cancel. We will provide notice of any price change in advance, and continued subscription after the change takes effect constitutes acceptance of the new price.
Cancellation. You may cancel at any time through your Substack account settings. Cancellation takes effect at the end of your current billing period, and you will retain access to paid content until then.
Refunds. All sales are final and subscription fees are non-refundable. Canceling does not entitle you to a refund for the current billing period. We may, in our sole discretion and on a case-by-case basis depending on the facts, issue a refund in limited situations such as a duplicate or double charge or another billing error, but we are under no obligation to do so except where a refund is required by applicable law. If you are a consumer in the EU or UK, you may have a statutory right to withdraw within 14 days of purchase; by starting your paid subscription and accessing content immediately, you request immediate performance and acknowledge that, to the extent permitted by law, your right of withdrawal may be lost once access begins.
Chargebacks. If you believe you were charged in error, contact us before initiating a chargeback so we can resolve the issue.
6. Intellectual Property
All content in the Publication, including text, graphics, data cards, infographics, data compilations, analysis, and the Gosships Intelligence name and logo, is owned by Gosships LLC or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and read the content for your own personal or internal professional use.
You may share links to published posts. You may not otherwise copy, reproduce, redistribute, republish, resell, scrape, data-mine, or use the content to train any machine learning or artificial intelligence model, or create derivative works, in whole or in part, without our prior written permission. All rights not expressly granted are reserved.
7. Subscriber Conduct and Acceptable Use
You agree not to: use the Publication or its content for any unlawful purpose; misrepresent Gosships Intelligence as a source of professional advice; redistribute, forward, or share paid content with non-subscribers; circumvent any paywall or access control; use automated means to access, scrape, or harvest content; reverse engineer or interfere with the Publication or its delivery; or infringe our or any third party’s rights. We may investigate and take appropriate action, including suspension or termination, for any violation.
8. Comments and User Submissions
If the Publication permits comments or other submissions, you retain ownership of the content you submit but grant Gosships LLC a worldwide, royalty-free, non-exclusive license to use, display, reproduce, and moderate that content in connection with the Publication. You are solely responsible for your submissions and represent that they do not violate any law or third-party right. We may remove, edit, or refuse any submission at our discretion.
Copyright complaints. If you believe content in the Publication infringes your copyright, notify us at intelligence@gosships.com with the information required by the Digital Millennium Copyright Act (DMCA), and we will respond as required by law. Comments hosted on the Substack platform are also subject to Substack’s own notice-and-takedown procedures.
9. Sponsorship and Partnerships
Sponsored content and partnership posts will always be clearly and conspicuously identified, consistent with Federal Trade Commission guidelines on endorsements and disclosures. We maintain editorial independence regardless of any commercial relationship.
10. Third-Party Links and Services
The Publication may contain links to third-party websites, tools, reports, and services that we do not control, including intel.gosships.com report offerings and academy.swiftaction.ai training. We are not responsible for the content, accuracy, products, or practices of third parties, and your use of them is at your own risk and subject to their terms.
11. Termination
We may suspend or terminate your access to the Publication, in whole or in part, at any time and without refund if you breach these Terms or if we reasonably believe your use creates legal or operational risk. You may stop using the Publication and cancel your subscription at any time. Provisions that by their nature should survive termination, including Sections 3, 4, 6, 12, 13, 14, and 15, will survive.
12. Limitation of Liability
To the fullest extent permitted by law, Gosships LLC and its owners, officers, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or trading or business losses, arising out of or relating to your use of or inability to use the Publication or its content, whether based in contract, tort, or any other theory, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Publication will not exceed the greater of the amount you paid us for the subscription during the twelve months preceding the claim, or one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing in these Terms limits liability that cannot be limited by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Gosships LLC and its owners, officers, and contractors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Publication, your violation of these Terms, your redistribution or misuse of content, or your violation of any law or third-party right.
14. Dispute Resolution, Governing Law, and Arbitration
These Terms and any dispute arising out of or relating to them or the Publication are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles.
Informal resolution. Before filing any claim, you agree to contact us at intelligence@gosships.com and attempt to resolve the dispute informally for at least 30 days.
Binding arbitration and class waiver. To the fullest extent permitted by law, any dispute not resolved informally will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small-claims court. You and Gosships LLC waive any right to a jury trial and agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class or representative proceeding. You may opt out of this arbitration and class-waiver provision by emailing us within 30 days of first accepting these Terms, in which case disputes will be resolved in the state or federal courts located in Delaware, to whose jurisdiction you consent.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide notice by email or through the Publication. Your continued subscription or use after the changes take effect constitutes acceptance of the updated Terms.
16. General
These Terms, together with the Privacy Policy, are the entire agreement between you and Gosships LLC regarding the Publication and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent, and we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for any failure or delay caused by events beyond our reasonable control. Section headings are for convenience only.
